This Service and mobile application are operated by FTM IT OÜ, a private limited company registered in Estonia under registry code 17181632 (registered on 20 February 2025), with its registered address at Tartu mnt 67/1-13b, Kesklinna linnaosa, Tallinn, Harju maakond, 10115, Estonia.

These Terms & Conditions (“Terms”) govern your access to and use of the SkyWhisper web-app, website, and related services (collectively, the “Service”). By accessing, or using the Service, you agree to be legally bound by these Terms, our Privacy Policy, and any additional guidelines or rules applicable to specific features of the Service.

If you do not agree to these Terms, you must not use the Service.

2. Eligibility

By using the Service, you confirm that:

• You are at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher;
• You have the legal capacity and authority to enter into binding agreements;
• You are not prohibited by any applicable laws from using the Service.

We may refuse access to the Service or terminate accounts if we reasonably believe you do not meet these eligibility requirements.

SkyWhisper is an astrology-based web application designed to deliver personalized astrological readings, insights, and related content for entertainment and informational purposes only. The Service may include, but is not limited to:

• Personal horoscope generation;
• Compatibility analysis;
• Astrological forecasts and reports;
• In-app communication features;
• Paid premium content and subscriptions.

The Service and all content are provided “as is” and are not intended to replace professional advice in areas such as health, finance, or relationships.

4. Account Registration & Security

To access certain features, you may need to create an account within the Service.
When registering, you agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account details;
• Keep your login credentials secure and confidential;
• Accept full responsibility for all activities under your account.

You must notify us immediately at support@skywhisper.app if you suspect unauthorized access to your account. FTM IT OÜ will not be liable for any losses or damages resulting from your failure to safeguard your account information.

5. User Conduct

When using the Service, you agree that you will not:

• Use the Service for any unlawful, fraudulent, or harmful purpose;
• Harass, abuse, or harm other users or any third party;
• Upload, post, or share content that is defamatory, obscene, or otherwise inappropriate;
• Interfere with or disrupt the operation of the Service, its servers, or networks;
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law;
• Use any automated means to access, scrape, or collect data from the Service without our prior written consent.

Violation of these rules may result in suspension or termination of your account without refund.

6. Paid Services & Subscriptions

Some features of SkyWhisper are available only through paid subscriptions or one-time purchases (“Paid Services”).
By purchasing any Paid Service, you agree to:

• Pay all applicable fees in accordance with the displayed pricing and terms at the time of purchase;
• Authorize us (and our third-party payment processors) to charge your chosen payment method;
• Accept that all fees are payable in advance and are non-refundable except as required by law or as outlined in Section 8 (Refund Policy).

Subscription plans will automatically renew at the end of each billing period unless you cancel in accordance with Section 7.

7. Subscription Renewal & Cancellation

• Automatic Renewal: Unless you cancel, your subscription will automatically renew at the end of each billing period, and your payment method will be charged the applicable subscription fee.
• Cancellation: You may cancel your subscription at any time by visiting the SkyWhisper website, logging into your account, navigating to Settings, and selecting Manage Subscription.
• Effect of Cancellation: You will retain access to premium features until the end of the current billing cycle. No partial refunds are provided for unused time.

8. Refund Policy

All purchases are final and non-refundable, except where required by applicable law.
If you believe you have been charged in error, contact us at support@skywhisper.app within 14 days of the charge, providing:

• Your full name;
• The email associated with your account;
• Proof of purchase.

We reserve the right to approve or deny refund requests at our sole discretion.

9. Intellectual Property Rights

All content, trademarks, logos, and other intellectual property displayed through the Service are the property of FTM IT OÜ or its licensors and are protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only.
You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

10. User Content

You may submit, upload, or share content through the Service, including text, images, or other materials (“User Content”).
By providing User Content, you:

• Grant FTM IT OÜ a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and improving the Service;
• Confirm that you have all necessary rights and permissions to share the User Content;
• Accept full responsibility for your User Content and any consequences of sharing it.

We reserve the right, but are not obligated, to remove any User Content that violates these Terms or is otherwise objectionable.

11. Disclaimers

The SkyWhisper Service is provided for entertainment and informational purposes only.
We do not guarantee the accuracy, completeness, or reliability of any astrological or other information provided through the Service.
FTM IT OÜ makes no warranties, express or implied, regarding:

• The Service’s availability or uninterrupted operation;
• The accuracy of results, predictions, or reports;
• Fitness for a particular purpose.

Use of the Service is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by law, FTM IT OÜ and its officers, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, data, goodwill, or other intangible losses;
• Damages arising from unauthorized access, use, or alteration of your transmissions or data.

If any liability is established, it will be limited to the amount you paid to use the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless FTM IT OÜ, its directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

• Your use of the Service;
• Your violation of these Terms;
• Your infringement of any third-party rights.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Estonia.

We may update or modify these Terms at any time by posting the revised version within the Service or on our website.
If changes are material, we will provide reasonable notice before they take effect.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
